What decides it

  • A European citizen not resident in Portugal registers in the EU country of residence, not again in Portugal; the number is valid across EASA states and double registration is forbidden.confirmed on the cited page
  • Registration is required when the maximum take-off mass is 250 g or more, or the impact energy exceeds 80 J, or the UA carries a sensor capable of capturing personal data.confirmed on the cited page
  • Registration is submitted online and remains pending until ANAC approves it; the operator number is issued by email on approval. No processing time is published.confirmed on the cited page

Permits tied to a place or a time

These do not change the country's colour; they decide whether a particular flight is legal where and when you want it.

  • Published geographical zones apply to all categories. A state may require a flight authorisation issued by the entity that manages the area, for example a natural park authority, and this is separate from any operational authorisation.

Before you fly, in order

  1. A European citizen not resident in Portugal registers in the EU country of residence, not again in Portugal; the number is valid across EASA states and double registration is forbidden.
  2. Registration is required when the maximum take-off mass is 250 g or more, or the impact energy exceeds 80 J, or the UA carries a sensor capable of capturing personal data.
  3. ANAC operator registration is free of charge.
  4. Registration is submitted online and remains pending until ANAC approves it; the operator number is issued by email on approval. No processing time is published.
  5. Operator registration must be revalidated every three years and kept accurate.
  6. The operator number is affixed to every aircraft as PRT plus 16 characters, without the three secret digits; the complete string including them is loaded into the remote-identification device.
  7. Open-category flights stay within 120 m of the surface; in mountainous terrain the 120 m is measured from the nearest point of terrain, so a flight launched from a ridge may be legal while far more than 120 m above the valley floor.
  8. Above an obstacle taller than 120 m, up to 15 m above the obstacle, only on the explicit request of its owner, and within 50 m horizontally.
  9. No overflight of uninvolved persons in the open category unless the UA is privately built under 250 g or carries a C0 or C1 label.
  10. Visual line of sight is required, or a UA observer assisting the remote pilot.
  11. Published geographical zones apply to all categories. A state may require a flight authorisation issued by the entity that manages the area, for example a natural park authority, and this is separate from any operational authorisation.
  12. FPV is permitted in the open category when an observer stands beside the pilot, keeps direct visual contact with the drone and can warn the pilot immediately.
  13. No source cited by either research pass establishes a declaration, import authorisation or confiscation policy for a personally carried drone. No customs source was ever cited.
  14. No source cited by either research pass states a Portugal-specific or Madeira-specific lithium battery carriage rule.
  15. The minimum remote-pilot age is 16 for the open and specific categories, except a class C0 drone in A1, where no minimum applies; member states may lower it.
  16. Spare lithium batteries in cabin baggage only: up to 100 Wh without approval, 100 to 160 Wh with airline approval and two spares, over 160 Wh not allowed (IATA passenger guidance; airlines may be stricter).

Spare lithium batteries in cabin baggage only: up to 100 Wh without approval, 100 to 160 Wh with airline approval and two spares, over 160 Wh not allowed (IATA passenger guidance; airlines may be stricter).

How a visitor gets legal

Each step as the authority describes it, with who may apply, what it costs and how long it takes.

  1. Step 1

Work out where your operator registration lives

An EU resident uses the registration issued by the member state of residence and must not register a second time. The number is valid across EASA states.

  2. Step 2

Third-country residents: register in the first EU country of operation

A UK, US or other third-country resident registers with the civil aviation authority of the first EU country of operation. If you land in Portugal and fly there first, that is ANAC; if you will fly in Spain first, it is AESA. ANAC's tutorial names any tourist without an EU address as an intended user.

Visitors eligible · free · pending ANAC approval, no published service level

  3. Step 3

    Complete the ANAC operator registration

Natural persons authenticate with Chave Móvel Digital. The form asks for name, tax number, date of birth, nationality, citizen-card or passport number, a Portuguese address, contacts, and insurer plus policy number where the mass exceeds 900 g, and you must accept a declaration that you are not registered in any other EU country. A visitor is eligible in principle; the Chave Móvel Digital and Portuguese-address requirements are an unresolved practical obstacle.

Apply to IFCN where the site is inside a protected area

Where the site falls inside an IFCN-managed protected area, a Natura 2000 site or an area under a management plan, apply through the SIMplifica drone service before flying. The service is listed in Portuguese only, including on IFCN's English-language pages. Its processing time, cost, eligibility and required documents could not be read.

May a visiting pilot fly at allYes, after a registration or a notification.Tourists may fly under the EU open category, subject to the published geographical zones and to protected-area authorisation where an IFCN-managed area applies. No official legal text, fee schedule or government service page establishes a Madeira-specific drone registration, payment or insurance requirement for tourists; a regional-government search for drones returns only the government's own use of drones for forest surveillance and cartography.confirmed on the cited pageS6S14S22
EU or EEA registration recognisedYesA European citizen not resident in Portugal registers in the country of residence; the registration number is valid in all EASA member states and double registration is forbidden.confirmed on the cited pageS1cS6
UK registration recognisedNoThe UK left the EASA system on 1 January 2021 and is a third country; UK-issued UAS certificates are not recognised in EU airspace. A UK-resident pilot registers with the national aviation authority of the first EU country of operation, which is ANAC if that country is Portugal.confirmed on the cited pageS6S4S1

Local registrationRequired from 250 g. Cost: free. Time: no published service level; the registration stays pending until ANAC approves it and the operator number arrives by email. Non-residents: passport and a valid entry visa, for a tourist with no address in an EU country. The 250 g threshold (the registry FAQ phrases it as greater than 249 g), the free cost, the portal and the tourist identity documents are stated on official ANAC pages. No processing time is published, and the natural-person flow requires Chave Móvel Digital authentication and a Portuguese address, which is in tension with the same tutorial's stated tourist eligibility. There is no mass threshold at all if the drone carries a sensor able to capture personal data.partly confirmedS1S4S5S8S9S2
Remote IDThe operator number is affixed to every aircraft in the fleet as PRT plus 16 characters, without the three secret final digits; the complete string including the secret digits is loaded into the remote-identification device. C2 in A2: lateral distance at least equal to the flight height (1:1) and never closer than 30 m horizontally, reducible to 5 m with an active low-speed mode. C3, C4, C5, C6 and private builds over 250 g: no uninvolved persons may be present in the operating area. No spectators in the open category.confirmed on the cited pageS6

Class marksOpen category: class labels C0 to C4, privately built UA under 25 kg, or legacy drones placed on the market before 31 December 2023, flown in subcategories A1, A2 or A3. The same document refers to class labels 1 to 6 when discussing purchase, so C5 and C6 exist but sit outside the open-category list.confirmed on the cited pageS6
FPVPermitted in the open category provided a UA observer stands beside the remote pilot, keeps direct visual contact with the drone and scans the airspace, so they can warn the pilot immediately.confirmed on the cited pageS6
Commercial useNo separate regime by purpose. The EU rules are risk-based and do not distinguish leisure from commercial activity; commercial services may be flown in the open category if the open-category requirements are met.confirmed on the cited pageS6

On the ground

What pilots, police and the press report actually happening. This is evidence about behaviour, not law: it never changes the status above, and it is dated and linked so you can judge it yourself.

Too few confirmed reports to say2 confirmed cases, 2 we could not open · 2026-08-30 to 2026-08-30 · practice pass 7 October 2026

One case is confirmed: a video near Madeira Airport was reported to ANAC and the police in August 2026 with no offence established at the time. Nothing we could open records a fine, a seizure or a stop anywhere else, and the community threads behind the wider reading were unreachable.

How people fly
No usable report.
Police and rangers
The one documented authority response is not a roadside stop: after a video of the airport surroundings went up on social media in August 2026, the case was formally reported to ANAC and to PSP airport security, with the National Aeronautical Authority and ANA also informed, and the authorities were to check the location, the altitude, the proximity to the runway and aircraft, and whether any authorisation existed.
At the border
A January 2026 report in Diario de Noticias da Madeira says passengers may carry their drone with them on the aircraft without having to declare it or present a special licence on arrival in Portugal, treating it as personal equipment.
Fines actually reported
None found. Both press reports on the August 2026 airport case state that at the time of writing nothing established an unauthorised flight or an offence, and no page this pass opened records a fine, a confiscation, an arrest or an operating ban imposed on a visiting pilot in Madeira.

The law's own penalty schedule is separate: Not established, 2 published fine ranges below.

Where reports cluster

  • Madeira Airport (Cristiano Ronaldo, LPMA) and the surroundings of runway 05/23

The only place with a confirmed authority response. A social-media video of the runway surroundings was formally reported to ANAC and PSP airport security in August 2026. The person who published it had argued in a public comment that Madeira has no restrictions and pointed at the app he used; the regional daily's fact-check that day names the airport among the prohibition zones ANAC itself identifies, so an app reading as clear is not a defence.

  • PR1 trail viewpoints between Pico do Arieiro and Pico Ruivo

[unverified] A July 2026 r/Madeira thread is reported to say many of the viewpoints visitors have in mind are restricted and need an application submitted in advance. The thread could not be opened, and no stop or penalty is reported there.

  • Funchal and other areas pilots read as unrestricted

[unverified] A January 2026 r/Madeira thread is reported to describe flights going ahead without problems where crowds, buildings and private property were avoided. The thread could not be opened, and such accounts do not establish that the flights had every authorisation.

What we could not confirm

Printed rather than hidden. A brief that answers everything has usually guessed somewhere, and a gap here is a real gap in the official pages or a page we could not reach.

4 cited pages refused our checks and are marked unreachable in the source list.

Sources that disagree

  1. Whether a non-resident tourist can in practice complete the ANAC registration, given the Chave Móvel Digital and Portuguese-address requirements. This needs a direct answer from ANAC (drones@anac.pt is published on the registry support page) before the product tells a US or UK pilot they can register on arrival.
  2. The minimum insured capital in euros. Portaria n.º 2/2021 fixes a minimum per annuity, but no figure appears on any page either research pass cited.
  3. Night flying. Not addressed by any ANAC or IFCN material opened in the verification pass.
  4. An enforcement rating for Madeira. No page supports one.
  5. Every fine amount, the confiscation policy and criminal liability. Only the offence basis survives: unregistered operation is a contraordenação under Decreto-Lei n.º 87/2021.
  6. All customs, import-declaration and battery matters. No customs source was ever cited.
  7. All radio-spectrum matters. No ANACOM source was ever cited.
  8. The Funchal LPMA CTR extent, the airport separation rule, Funchal municipal restrictions and Porto Santo restrictions. No NAV Portugal, ANA Aeroportos, AIP or municipal source was ever cited.
  9. Site-level drone rules for Pico do Arieiro, Pico Ruivo, Fanal, Penha de Águia, the levada trails, the Ilhas Desertas and the Selvagens. What survives is the Natura 2000 classification of the central mountain massif, the Laurissilva and Ponta de São Lourenço.
  10. The geozone dataset licence and update cadence. The format is known; neither of these is stated on the map page.
  11. The conditions, cost and eligibility of the IFCN drone authorisation. simplifica.madeira.gov.pt/services/8-25-282 is a JavaScript application: both the free-of-charge claim and the exact legal trigger for the permit are unverified, even though the existence of the service is confirmed twice on IFCN's own pages.
  12. The January 2026 press report of a Madeira tourist drone requirement. No official legal text, fee schedule or government service page establishes a Madeira-specific drone registration, payment or insurance requirement for tourists, and neither research pass cited the press report itself, so the press claim could not be checked either. The regional-government passage offered as support is about classified pedestrian trails, not drones.
  13. Any community, forum, press or creator account of flying in Madeira. Every URL across both research passes is a government domain, so there is no dated pilot account and no enforcement anecdote.
  14. Which apps, if any, the authority recommends. ANAC's own material points to the national map, not to a third-party app.
  15. DJI GEO-zone behaviour in Madeira. No source; the caution that a DJI unlock is neither permission nor evidence of legality is retained as guidance, not as a sourced claim.
