Belgium

An EU or EASA operator registration and pilot certificate are valid in Belgium. Residents outside the EU must register free with the DGLV and pass the EU A1/A3 exam from 250 g, as home certificates do not count. Check Droneguide before every flight; Wallonia bans drones over nature reserves.

Some key fields rest on secondary sources; they are listed under what we could not confirm.

What decides it

  • Below 250 g, registration is still required if the drone has a camera or other sensor able to capture personal data, unless it complies with the toy directive 2009/48/EC.confirmed on the cited page
  • Display the operator number on every drone so it is visible and readable on the ground, by marker, sticker or QR code (on the battery compartment if the drone is too small, provided it is easy to reach), and upload it into the remote-ID system where one is fitted.confirmed on the cited page
  • The remote pilot must be at least 14 for A1 and A3 and at least 16 for A2. There is no minimum age for a C0 that is also a toy, or a privately built drone under 250 g, flown in A1.confirmed on the cited page
  • The bands listed for drone remote control, telemetry and video are 2400 to 2483.5 MHz at 100 mW EIRP and 5725 to 5875 MHz at 25 mW EIRP. The drone and remote control must carry the CE marking with an EU declaration of conformity referencing the radio equipment directive.confirmed on the cited page

Permits tied to a place or a time

These do not change the country's colour; they decide whether a particular flight is legal where and when you want it.

  • Flying over an assembly of people is outside the OPEN category and needs a SPECIFIC authorisation from the DGLV.
  • VLL 0, the box over each runway of a civil controlled aerodrome (runway length plus 3 km each end, 2 km wide), is permanently closed to all OPEN-category flights.
  • In VLL 1 around a civil controlled aerodrome (active per AIP or NOTAM), OPEN flights stay below 150 ft AGL and below the highest obstacle within 100 m, and need prior permission from SPACC and the zone manager, notification at start and end of each flight, direct remote ID and geo-awareness. Requests go through skeyes' free DAA Planner.
  • Uncontrolled civil aerodromes, heliports, seaports and royal domains need prior permission from the zone manager. Prisons also need direct remote ID and separate written approval for any recording; nuclear installations need permission, remote ID and geo-awareness; military domains need permission and ADIV approval for any remote sensing aimed at the installation.
  • Flights beyond visual line of sight, above 120 m, over an assembly of people or with dropping fall in the SPECIFIC category: an operational authorisation (EUR 500) or a standard-scenario declaration (EUR 150 a year) through the Drone Portal, after registering as an operator.
  • An operator holding a SPECIFIC authorisation from another member state must apply to the DGLV by email and may start once the DGLV confirms acceptability (EUR 250 per application).

Before you fly, in order

  1. Below 250 g, registration is still required if the drone has a camera or other sensor able to capture personal data, unless it complies with the toy directive 2009/48/EC.
  2. An operator registered in an EU or EASA state registers only there and need not register again in Belgium to fly in the OPEN category. Carry the proof of registration and display the number on the drone.
  3. Registration as a UAS operator is free.
  4. Display the operator number on every drone so it is visible and readable on the ground, by marker, sticker or QR code (on the battery compartment if the drone is too small, provided it is easy to reach), and upload it into the remote-ID system where one is fitted.
  5. A valid EU A1/A3 or A2 certificate issued in another member state is valid in Belgium without extra obligations in the OPEN category.
  6. No insurance is required where only drones under 900 g used for private purposes are flown.
  7. Flights beyond visual line of sight, above 120 m, over an assembly of people or with dropping fall in the SPECIFIC category: an operational authorisation (EUR 500) or a standard-scenario declaration (EUR 150 a year) through the Drone Portal, after registering as an operator.
  8. An operator holding a SPECIFIC authorisation from another member state must apply to the DGLV by email and may start once the DGLV confirms acceptability (EUR 250 per application).
  9. No higher than 120 m above the nearest point of the ground; within 50 m of an artificial obstacle taller than 105 m, up to 15 m above it at the request of the entity responsible for the obstacle.
  10. Flying a C2 close to people in subcategory A2 needs the A2 certificate: the A1/A3 certificate first, then a free A2 theory exam taken in person at the DGLV in Brussels and a signed declaration of practical self-training. Minimum age 16.
  11. A1: never over an assembly of people, and with a C1 not intentionally over uninvolved persons. A2: 30 m from uninvolved persons, 5 m in low-speed mode, never over them, 1:1 rule. A3: 150 m from residential, commercial, industrial or recreational areas, 30 m from persons, 1:1 rule, and at least the distance covered in 2 seconds at maximum speed.
  12. Flying over an assembly of people is outside the OPEN category and needs a SPECIFIC authorisation from the DGLV.
  13. Fly only within visual line of sight; follow-me mode is allowed up to 50 m from the remote pilot.
  14. Night flights are allowed only within visual line of sight and with an activated green flashing light on the drone.
  15. Check Droneguide before every flight, recreational or professional. Geozone access conditions apply on top of the category rules and cumulatively, the strictest applying where zones overlap. A geozone permission from skeyes or the zone manager is separate from a DGLV operational authorisation.
  16. VLL 0, the box over each runway of a civil controlled aerodrome (runway length plus 3 km each end, 2 km wide), is permanently closed to all OPEN-category flights.
  17. In VLL 1 around a civil controlled aerodrome (active per AIP or NOTAM), OPEN flights stay below 150 ft AGL and below the highest obstacle within 100 m, and need prior permission from SPACC and the zone manager, notification at start and end of each flight, direct remote ID and geo-awareness. Requests go through skeyes' free DAA Planner.
  18. Uncontrolled civil aerodromes, heliports, seaports and royal domains need prior permission from the zone manager. Prisons also need direct remote ID and separate written approval for any recording; nuclear installations need permission, remote ID and geo-awareness; military domains need permission and ADIV approval for any remote sensing aimed at the installation.
  19. Flights need not be notified, except in a geozone that requires notification.
  20. FPV flight needs an unmanned aircraft observer standing next to the remote pilot and watching the drone without aids.
  21. The bands listed for drone remote control, telemetry and video are 2400 to 2483.5 MHz at 100 mW EIRP and 5725 to 5875 MHz at 25 mW EIRP. The drone and remote control must carry the CE marking with an EU declaration of conformity referencing the radio equipment directive.
  22. Recordings are subject to the GDPR. Privacy is outside the DGLV's competence: complaints go to the Data Protection Authority or the police.
  23. The remote pilot must be at least 14 for A1 and A3 and at least 16 for A2. There is no minimum age for a C0 that is also a toy, or a privately built drone under 250 g, flown in A1.
  24. The rules make no distinction between recreational and commercial purpose; professionals may fly in the OPEN category within its conditions.
  25. Spare lithium batteries in cabin baggage only: up to 100 Wh without approval, 100 to 160 Wh with airline approval and two spares, over 160 Wh not allowed (IATA passenger guidance; airlines may be stricter).

Spare lithium batteries in cabin baggage only: up to 100 Wh without approval, 100 to 160 Wh with airline approval and two spares, over 160 Wh not allowed (IATA passenger guidance; airlines may be stricter).

How a visitor gets legal

Each step as the authority describes it, with who may apply, what it costs and how long it takes.

  1. Step 1

    Classify the flight

Establish the take-off mass, the class label or legacy status, whether the drone has a camera, the subcategory and where you will fly.

May a visiting pilot fly at allYes, after a registration or a notification. No flight permit or notification is needed in the OPEN category outside geozones that require one. What is needed is an operator registration (home EASA registration counts), pilot competency from 250 g, insurance for a drone of 900 g or more or any non-private use, and the access conditions of any geozone flown in.confirmed on the cited pageS1S2S3S22
EU or EEA registration recognisedYesAn operator registers only once, in the state of residence, and need not register again in Belgium to fly OPEN. EU and EASA pilot certificates (A1/A3, A2) are valid without extra obligations. Remote IDC1, C2 and C3 drones carry direct remote identification; C0 and C4 do not need it. Where the drone has a remote-ID system the operator number must be uploaded into it. Some geozones require direct remote ID even in the OPEN category, and the SPECIFIC category requires it since 1 January 2024.The query premise said remote ID applies from C1 upwards; the authority's FAQ limits it to C1, C2 and C3. Where the no-fly zones are published

The authority's own map is the one that counts on the day; an app is a convenience, not a source.

Around civil controlled aerodromes: VLL 0 over the runways (runway length plus 3 km each end, 2 km wide) is closed to all OPEN flights; VLL 1 (4,500 m cylinder up to 400 ft, approach boxes, and the CTR above 400 ft) allows OPEN flights below 150 ft AGL only with SPACC and zone-manager permission, flight notification, remote ID and geo-awareness. Uncontrolled aerodromes: at least 800 m around the circuits, permission of the zone manager.

Radio conformity
The BIPT enforces the radio equipment directive: the drone and its remote control must carry the CE marking with an EU declaration of conformity referencing Directive 2014/53/EU, and power and frequency must be stated in the instructions. Listed bands: 2400 to 2483.5 MHz at 100 mW EIRP and 5725 to 5875 MHz at 25 mW EIRP. Non-compliant drones can be confiscated.

On the ground

What pilots, police and the press report actually happening. This is evidence about behaviour, not law: it never changes the status above, and it is dated and linked so you can judge it yourself.

Enforced14 confirmed cases · 2022-07 to 2026-09-16 · practice pass 8 October 2026

Fourteen dated press reports, 2022 to 2026, none involving a visitor: police find pilots by detection at events, Kleine-Brogel air base, Antwerp and airports, and seize the drone. Two fines located, up to EUR 12,000. Nothing found for nature reserves, tourist towns, the countryside or customs.

How people fly
The confirmed cases are ordinary local flying in the wrong place: a resident filming the Tomorrowland campsite from his garden, a man flying over houses and gardens out of sight and above 120 m in Hasselt, a night flight over central Mechelen that ended on a school playground, people testing a new drone, filming livestock, a go-kart track or a house for sale in the fields beside Kleine-Brogel air base, a real estate agent photographing a building in the extension of Charleroi's runway. The police commissioner at Kleine-Brogel says most do not know the rules and treat a drone as a toy. In the Hautes Fagnes the forest guard of the Fagne de Malchamps had the nature park remind drone owners in 2021 that the reserves had become popular with them and that overflight is banned.
Police and rangers
Detection does the finding. Hasselt's police located a pilot with the Skeydrone application and seized two drones in August 2024; Antwerp's drone team located two pilots in one week of November 2025, landed their drones, seized them and wrote official reports; skeyes detected the drone over Charleroi airport on 2026-09-16 and police took the pilot the same afternoon. At events under a temporary geozone, police seized 7 drones at Tomorrowland 2022, 11 in 2024 and 12 in 2025, one at Pukkelpop 2024, and 8 or 9 at Antwerp's Tall Ships Races in July 2026 with 9 official reports; Ghent's police counted six pilots over the Gentse Feesten zone in 2026. At Kleine-Brogel air base the Noord-Limburg police send a team when the base calls, write an official report on the spot and seize the drone, seven times from January to May 2026. Near Brussels Airport the aviation police seized a journalists' drone at the fence on 2025-11-14 although nothing showed it had flown, and wrote no report. None of the 14 confirmed cases names a foreign or visiting pilot. All of them sit in a geozone: a temporary event zone, a military zone or an airport control zone, which is where the law block's access conditions apply. No case was found under Wallonia's statutory ban over nature reserves or Flanders' low-flight ban, and no ranger encounter beyond the 2021 Hautes Fagnes reminder.
At the border
No usable report.
Fines actually reported
Two amounts actually imposed were located. A resident who flew a 249 g drone from his garden in Reet over Tomorrowland's DreamVille campsite on the first day of the 2023 edition was fined EUR 8,000, of which EUR 6,000 suspended; he paid the EUR 2,000 in instalments and got the drone back about two years later because he had lodged an objection. For Tomorrowland 2025 the aviation authority imposed 14 administrative fines ranging from EUR 200 to EUR 12,000, alongside 12 drones seized by police. Everything else located is a seizure and an official report with the amount still to be set: Runkst 2024, Pukkelpop 2024, Antwerp 2025, Mechelen 2025, Kleine-Brogel 2026, the Tall Ships Races 2026. The statutory range of art. 32 of the 1937 aviation law stays in the law block; no located amount comes near its top.

The law's own penalty schedule is separate: Not established, 3 published fine ranges below.

Published penalty ranges. What has actually been charged, where anyone reported it, is in the section above.

OffenceRangeSources
Breach of EU civil-aviation regulations, including (EU) 2019/947, or of the royal decrees implementing the 1937 aviation law, where no special penalty is setImprisonment from 8 days to 1 year and a fine from EUR 200 to EUR 4,000,000, or either alone (law of 27 June 1937, art. 32). An administrative fine can be imposed instead of prosecution, within the same range increased by the statutory surcharges (art. 45 and 48).S23
Breach of ministerial regulations on aviationImprisonment from 8 days to 1 year and a fine from EUR 200 to EUR 1,000,000, or either alone (art. 32, second paragraph). Whether the geozone ministerial decree falls under this paragraph is not stated.S23S24
Intentional or negligent breach of the OPEN-category rulesThe minister may ban the remote pilot or operator from any UAS operation for up to 24 months and suspend or withdraw an A2 certificate (royal decree of 8 November 2020, art. 11). An administrative measure, not a fine.S22

Confiscation: The BIPT may confiscate a drone whose radio characteristics are not compliant and draws up an official report. Separately, an aircraft whose required documents are not produced, or whose registration marks do not match, may be detained until its identity or its operator's is established (law of 27 June 1937, art. 37).

Criminal liability: Yes. Breaches of the EU drone rules and the Belgian implementing decree are offences under art. 32 of the law of 27 June 1937, prosecuted by the public prosecutor of the place of the offence or of the defendant's residence (art. 36).

What we could not confirm

Printed rather than hidden. A brief that answers everything has usually guessed somewhere, and a gap here is a real gap in the official pages or a page we could not reach.

9 cited pages refused our checks and are marked unreachable in the source list.

Sources that disagree

  1. How a resident outside the EU without a Belgian eID or itsme logs into the Drone Portal to register and to sit the A1/A3 exam. The authority says they must register; the only login methods it publishes are eID and itsme.
  2. The registration processing time and the documents a non-resident supplies; the portal pulls identity data from the Belgian national register.
  3. Whether a foreign address and telephone number are accepted at registration.
  4. The geozone dataset behind Droneguide: whether it can be downloaded, and its format, licence and update cadence.
  5. Customs: any declaration, import authorisation or confiscation practice for a traveller's drone. FPS Finance was unreachable, and the practice pass found no press report in Dutch, French or English of a drone checked or seized at a Belgian airport or border.
  6. Any Belgium-specific lithium battery carriage rule.
  7. Whether the geozone ministerial decree falls under the EUR 1,000,000 or the EUR 4,000,000 ceiling of art. 32 of the 1937 aviation law.
  8. The surcharge multiplier that turns the statutory fine range into the amount actually payable; the statute does not state it.
  9. The text of the Brussels ordinance of 1 March 2012, art. 27, and of the Flemish decree of 21 October 1997, art. 35, both known here only through the Constitutional Court judgment.
  10. Which parts of Hoge Kempen National Park are nature reserves with a type 4 management plan, and whether the park has a drone rule of its own.
  11. Whether any Belgian Natura 2000 site carries a drone rule of its own.
  12. The Filmloket's procedure, fee and lead time, and whether it serves a visiting recreational pilot.
  13. Municipal drone rules in Bruges, Dinant, the Ardennes or on the coast; no municipal domain was searched. For Ghent the practice pass found only the press report of a police-regulation no-fly zone around the centre during the Gentse Feesten, not the regulation itself.
  14. Whether a recreational visitor is eligible for a SPECIFIC authorisation.
  15. The live state of every authority page after its archive capture date (captures run from 2025-04 to 2026-08).
  16. Whether a visiting or foreign pilot has ever been stopped, fined or had a drone seized in Belgium. None of the 14 cases the practice pass confirmed names one.
  17. Whether the Walloon ban over nature reserves or the Flemish low-flight ban has ever been enforced against anyone. The practice pass found no case, only a 2021 ranger-requested reminder for the Hautes Fagnes.
  18. How the seizures end. The press reports the official report and the seized drone, rarely the fine; the outcomes of the Charleroi 2026, Antwerp 2025 and 2026, Kleine-Brogel 2026 and Gentse Feesten 2026 cases were not located, and no published court decision was found.
  19. What HLN, Gazet van Antwerpen, Het Nieuwsblad, De Standaard and Het Belang van Limburg reported: they refuse every automated client used here, so the Flemish regional press was read only where VRT or other outlets relayed it.
